CONYERS -- Seven individuals with the Rockdale County Sheriff's Office have been named in a lawsuit alleging that a man and wife were unlawfully arrested and that the man was denied medical treatment at the jail.
According to the complaint filed in U.S. District Court, Northern District of Georgia, Ernest Edgar "Buck" Black and Amy Elizabeth Black were arrested by officers with the Sheriff's Office in August 2010 after their trailer was entered by officers without a warrant. The Blacks allege that they were held at the Rockdale County Jail until Sept. 27, 2010, and that while at the jail Mr. Black suffered a fall that left him with a disability.
Named in the lawsuit are Sheriff Jeff Wigington, Robert Wilson, David Kain, Andy Stamatellos, Bernice Louise Jones, Tom Eaton and Dennis Pass.
The Blacks are seeking more than $2.5 million in compensatory and punitive damages, as well as attorney fees.
According to the lawsuit, an officer with the Sheriff's Office had been to the Blacks' trailer at 1651 River Circle sometime prior to Aug. 10, 2010, to serve an arrest warrant for another man. The complaint states that Mr. Black, who is a former deputy, told the officer that the man did not live there.
Subsequently, on Aug. 14, two of the defendants in the lawsuit attempted to serve an arrest warrant for the man at the same address, according to the complaint, without any knowledge that the other officer had been told the suspect did not live there.
The lawsuit alleges that those two defendants illegally entered the residence, which was not occupied at the time, and saw evidence, which resulted in a search warrant being obtained. Items seized in that search led to the arrests of the Blacks on drug and weapons charges.
While in jail, Mr. Black alleges that he slipped and fell in standing water and injured his left knee, leg and arm. He claims he was denied proper medication, physical therapy and other privileges given to other inmates.
The lawsuit, which was filed in September, is now in the discovery phase, according to attorney Ralph Goldberg, who represents the Blacks. The Sheriff's Office defendants are represented by attorney Kevin Morris of Buford, who filed a response in November denying the plaintiffs' allegations.

This is so laughable. As many people as he scammed back when he ran an auto repair shop and now he is trying to scam the county.

Arrests should be lawful. There have been way too many departments and offices that have ignored all aspects to obeying the law. Not only do they break the law openly and constantly, they flaunt it. They feel as if they are exempt from obeying the laws that they enforce. Seeking justice is not trying to scam the county. They are not suing the county, they are suing individuals. I wish them the best of luck. With Levett at the helm, not soon enough, such atrocities will cease as they should have years ago. This is unconscionable and should have never happened in the first place. It is in everyone's, including law enforcement, best interest to obey the law. It can get a lot better and it should.

maybe you should find out the facts before you autmatically condemn the Deputies. Im sure this is only the Black's side of the story which is always the case when a lawsuit is made public. Yes there are some that think they are above the law, but the majority are not that way. And what makes you think Levett will stop "such atrocities"? Who do you think will pay the bill if the Deputies lose?

This won't go anywhere but it's about time somebody took these fools to task! There's a ton of good cops out there but here locally we are overrun with the "God complex" deputies. Hopefully this will slow them down. You can't enter a house without a warrant but that doesn't seem to matter to these guys. To bad the Blacks aren't related to the Wigington's, then all their problems would magically disappear!

Southside, note the word man in travelingman which obviously denotes a male. I mean, Really? The second sentence is right on, that is if he decides to leave. AWOL, their family name is Black. Are you always this way? Rob, right on. Frustrated, these are personal law suits. The county won't be out a dime. If the deputies lose then the deputies pay, not the county. Frizzlefly, was that supposed to be funny? Superman, where do you get your information, from the junkyard factory?

Travelingman, i'm not sure if you are an unhappy former employee or an unhappy current employee, but you are either naive or ignorant. The deputies work for the county and unless they were obviously and intentionally violating the law the county will be responsible in a law suit. Sheriff Levett will do a great job but it will take time. The deputies in Rockdale do a great job and will continue to do great with or without the good opinion of you and Rob.

Lorenzo you are absolutely right. Unless the Deputies were violating rules and regulations the county will be on the hook. Im still not sure about Levett doing a good job though. I think there are hard times ahead.
